Submission of audited balance sheets and other financial statements as required in the BDS Clause 17, for the past Five years (2013-2017 EFY) to demonstrate the current soundness of the Bidder’s financial position.

The audited report must be original or authenticated. Annual financial statements shall be prepared by Certified Auditors (not by an accountant or accounting firms).

Financial statements prepared by accounting firms will not be accepted.

The bidders must attach external auditor’s trade license, VAT certificate, and related legal testimonies.

Annual turnover in construction work of minimum of ETB 585,000.000 (peak of the past 5 years) calculated as total certified payments received for contracts in progress or completed within the 5 years [insert required figure]. (Local currency devaluation rate could be considered)

The Bidder must demonstrate access to, or availability of, financial resources such as liquid assets, unencumbered real assets, lines of credit, and other financial means, other than any contractual advance payments to meet the following cash-flow requirement: 162,500,000 ETB

Note’- Unconditional Letter of Credit, Loan or Overdraft Facilities Specific to this project from an accredited Bank

Bidder has to submit valid business license indicating the stream of business in which the Bidder is engaged, in accordance with ITB Clause 4.5(b)(i);

 In the case of a bid submitted by a Partnership, Consortium or a joint venture (JV), the Bidder has to submit the Form Data on Partnership, Consortium or Joint Ventures, the Agreement governing the formation of joint venture, or letter of intent to form Partnership, Consortium or Joint Venture, including a draft agreement, in accordance with ITB Clause 4.1.

Bidder has to submit valid business license indicating the stream of business in which the Bidder is engaged, in accordance with ITB Clause 4.5(b)(i);

 Bidder has not been debarred by a decision of the Public Procurement and Property Administration Authority from participating in public procurements for breach of its obligation under previous contracts, in accordance with ITB Clause 4.3;

Bidder does have nationality in accordance with ITB Clause 4.2.

Bidder is found to have a conflict of interest as described in ITB Clause 6;

Bidder has to submit business organization registration certificate in accordance with ITB Clause 4.5(c).

Adequacy of Technical Proposal in responding to the Schedule of Requirements

Bidder has failed to provide CVs of the Professional staff signed by the staff themselves or by the authorized representative of the Professional Staff.

 Certificate of Contractor Registration from Ethiopian Construction Authority with Category GC/WWC-1 and for Electro-mechanical Grade-1 contractor From Petroleum & Energy Authority (P.E.A) renewed for 2018 EFY. The bidder shall be formed as a Joint Venture (JV) comprising either a GC-1 or a WWC-1 as a lead partner, together with a mandatory Electro-Mechanical Contractor Grade 1 as JV partner, and optionally all three parties may participate jointly in the same JV, all being jointly and severally liable for full contract execution in accordance with Ethiopian Public Procurement requirements.

Note: A proposed staff with MSc degree will be required 2 years less experience than the above requirement for General Work Experience;

• full time, bidder shall provide payroll supported by receipts from revenue and custom authority or employment agreement testimonials approved by labor and social affairs for the proposed person working with the Company itself or pension contribution transfer document to the mandated public body. The above required documents shall be for the first three months from the date of employment and the last three months before bid submission date;
• The personnel for all part time staff should write and sign his/her availability and willingness form for this specific project, time and assignment position. Non-attachment of signed willingness form leads to fail for the proposed position;
• General experience shall mean experience after educational graduation in any construction project;
• Specific experience in similar position shall mean experience in building construction in the required

Position.

• Only one candidate shall be proposed for one position
• If a professional who is in permanent position is proposed by another bidder, the bidders will fail to get the allotted point for corresponding professional
• If the project is awarded changing the proposed qualified personnel is not allowed unless authorized by the Employer ascertaining the new personnel is at least equivalent to the employer requirement in relation to the stated qualification
• If the proposed person is not qualified but the project is awarded, the winner shall provide a substitute employee equivalent to the employer requirement for the corresponding position before signing of an agreement.

The number of points to be assigned to each of the above positions or disciplines shall be determined considering

30% for Total Work Experience sub-criteria and 70% for Experience in Similar Works.

The Bidder has successfully participated as contractor or subcontractor, in at least [insert required number of contracts] two waste water treatment or sewer line contracts or installation testing & commissioning of hospital wastewater treatment plant within the last [insert required number of years] 10 years, each with a value of at least 568,750,000 ETB[insert value of contracts], that have been successful and substantial completion of 70%.

Or

The Bidder has successfully participated as contractor or subcontractor, in at least [insert required number of contracts] three waste water treatment or sewer line contracts or installation testing & commissioning of hospital wastewater treatment plant within the last [insert required number of years] 10 years, each with a value of at least 380,000,000 ETB[insert value of contracts], that have been successful and substantial completion of 70%..

Supporting evidence letter for satisfactory performance from the employer which clearly mention the project amount, commencement date, project duration, completion date, timely performance and quality Performance are mandatory and must be attached. All documents attached must be Authenticated.

In addition, the bidder shall present contract agreement (form of agreement) and recent payment certificates.

Note:

· Specific Experience of bidders obtained through sub-contracting, which is not authenticated by the Project Owner/Employer (not the prime contractor) will not be considered. If a bidder has obtained experience by sub-contracting in projects, it should attach all payment Certificates certified by the prime contractor and also the receipt for tax paid to Ethiopian Revenues or relevant Authority.

· Moreover, for specific experience, in addition to the letter of Certificate of Experience (or Certificate of substantial completion), the bidder should attach copies of all to-date payment certificates and also the receipt for tax paid to Ethiopian Revenues or relevant Authority or otherwise will be considered as non-compliant and disqualified.

· During evaluation, the Client may enquire for additional documents that substantiates the specific experience records indicated by bidders”

·  Failure to do so will result automatic rejection from the bid

Bidder has failed to provide in the Bidder Certification of Compliance Form information about contracts similar to the proposed Works in the number, value, and period 

Non-performance of a contract did not occur within the last 5 years prior to the deadline for Bid submission, based on all information on fully settled disputes or litigation. A fully settled dispute or litigation is one that has been resolved in accordance with the Dispute Resolution Mechanism under the respective contract, and where all appeal instances available to the bidder have been exhausted

All pending litigation shall in total not represent more than 5 percent of the Bidder’s net worth and shall be treated as resolved against the Bidder.

The Bidder has at least five years firm experience in Construction Sector as Contractor, Sub contractor and Joint Venture.

The Bidder has successfully participated as contractor or subcontractor or joint venture in at least [insert required number of contracts] one waste water treatment or sewer line contracts or installation testing & commissioning of hospital wastewater treatment plant within the last [insert required number of years] 10 years, with a value of at least 1,137,500,000.00 ETB [insert value of contracts], that have been successful and substantial completion of 70%.

The Bidder has successfully participated as contractor or subcontractor, in at least [insert required number of contracts] two waste water treatment or sewer line contracts or installation testing & commissioning of hospital wastewater treatment plant within the last [insert required number of years] 10 years, each with a value of at least 568,750,000 ETB[insert value of contracts], that have been successful and substantial completion of 70%.
